全球化研發的數據合規挑戰

對於任何一個有全球拓展計畫的車企或技術供應商而言，跨國研發與測試往往不可避免，例如驗證演算法在不同交通環境、氣候條件下的魯棒性。然而，真實世界影像數據在使用時，往往會捕捉到大量 個人身份資訊（PII），如行人面部特徵、清晰可辨的車牌號碼等。

全球數據法規的差異與現實

自歐盟《通用數據保護條例》（GDPR）樹立全球數據保護的里程碑後，隱私立法改革隨之在全球展開，中國《個人資訊保護法》（PIPL）便是其中的重要組成。雖然這些法規均以保障個人資訊為目標，但在 定義、原則及跨境規則 上存在差異，給全球車企帶來巨大挑戰。

以 GDPR 與 PIPL 為例：

  • 數據定義範疇

    • GDPR 第四條：定義極為廣泛，凡「與已識別或可識別的自然人相關的任何資訊」，例如影像數據中的人臉、車牌號，均屬於此列。

    • PIPL 第四條：同樣範圍廣泛，但明確將「匿名化處理後的資訊」排除，為數據合規利用指明方向。

  • 處理原則要求

    • GDPR 第五條：確立六大核心原則，首要為「合法、公平、透明」。

    • PIPL 第五條與第六條：強調「合法、正當、必要、誠信」及「最小化影響」原則。

  • 跨境數據傳輸機制

    • GDPR 第五章：以「充分性認定」和標準合約條款（SCCs）為核心。

    • PIPL 第三十八條：採取「安全評估、認證、標準合約」三選一；第四十條更規定大規模數據處理者須經國家安全評估。

這種「一國一策」的格局，迫使車企必須精細化管理全球數據流。否則，不僅可能影響業務拓展，更可能面臨 巨額罰款與聲譽風險。在數據主權時代，擁抱合規並運用匿名化等前沿技術，已是企業生存與發展的必選項。

技術破局：如何兼顧隱私與數據價值？

透過技術手段，若能將數據中的個人身份資訊徹底移除且不可逆，那麼這些數據便能合法自由地跨境流通，用於 AI 訓練與演算法分析。
但問題在於：如何同時保護隱私，又保留數據對研發的價值？
